In granting a joint request to extend the jurisdictional discovery schedule by a single day, Magistrate Judge Peck saluted the parties in the highly contentious da Silva Moore v. Puhlicis Groupe and MSLGROUP for reaching agreement on this admittedly minor request: “It is nice to see the parties agree on something (even if it is minor) -perhaps you can keep working on cooperation in other areas.” The Court likely appreciated this respite from the frequent discovery disputes that have come before him in the case, including a recusal motion directed against Magistrate Peck due to his endorsement of the use of predictive coding in e-discovery, which we have covered in several previous posts.
