Tonight, the Southern District posted a form to use for “related case” statements. It is available here. “Related case” statements are part of a new rule, effective January 1, in which a plaintiff seeking to have a case heard before the same judge as an earlier, “related” case must file a statement “stating clearly and succinctly the basis for the contention.” The opponent can challenge that contention, and a three-judge committee has ultimate authority over related case determinations.
